TERMS AND CONDITIONS

GENERAL INFORMATION:

• If you have a specific budget, please make sure to inform me about it, and I will provide you with available options.

• Please do not submit the form if you are unsure of your capabilities.

•  I can work in various styles, from stylized cartoons to realistic artwork. Feel free to check my portfolio to determine your preferred style.

• Communication during the commission takes place via e-mails only.

• My preferred working tool is Photoshop, and the client receives a PNG or JPG image at the end of the work. If you need a PSD file with prepared layers, let me know in advance.

• The commissioned artwork will be sent in high resolution. If you require specific dimensions, kindly let me know during the sketch phase.

• While writing a form please provide specific references and/or a design mock-up (photos/art/images brief) for your commission alongside detailed text brief. I will not replicate other artists' work that is not your property, unless explicitly agreed upon. The more information you include about the illustration you want me to create for you, the better and more precise my work will be.

• The price stated in the commission form is a general estimate and may vary depending on the complexity of the character's design and elements, and time budget (eg. if there is a specific deadline to meet or not).

• Future slot openings' prices may vary due to external circumstances.

TERMS OF SERVICE:

• Ownership Rights: The commissioned artwork remains the intellectual property of the artist Alexandra Pernau or "Alex Pernau". Once payment is made, the client will have the right to use the artwork for personal purposes as outlined in the Use Policy section. The client is granted a non-exclusive license for personal use only, if there is a need for commercial use licence, copyright transfer, inform me about it in advance.

• How to Commission: please complete the online form. Please ensure that all personal information you provide is true. If I want to take this commission, I'll get back to you as soon as possible.

• I require an advance deposit of 30% to 50% depending on the final price of the commission to start working. New clients are usually charged 50%.

• At the end of the work, I issue an invoice to the client with the remaining amount that should be paid within 7 days to the bank account provided or online payment service.

• Payments can be made through an Invoice to my provided bank account in YEN, or in USD via Paypal or Wise, provided the service usage fees of these services are covered.

• By commissioning me, you agree to allow the display of the artwork in my portfolio and on my social media.

• If there is need for a NDA, please inform me in advance and let me know the period the NDA is valid for.

• Completion time for the commission will range from 2 weeks to 2 months, depending on the client's requirements and my workload. I will maintain regular contact with you throughout the process. If you require a specific deadline, please inform me in advance. Note that a shorter deadline may result in a higher commission price.

• Any changes to the artwork will be discussed and decided during the sketch phase. Once the coloring has started, only minimal changes will be possible.

• I reserve the right to utilize the illustration as I see fit, including recording and streaming (unless there is a NDA).

• Confidentiality: Any sensitive information shared during the commission process will be kept confidential and will not be disclosed to third parties without the client's and artist’s explicit consent.

• Delivery and Shipping: I do not make any physical copies of commissioned DIGITAL artwork, but the client has a right to print the commissioned artwork for personal use, unless additional rights were provided via bought licence. For original traditional media pieces, delivery and shipping options and costs will be discussed separately from the commission fee on a case by case basis.

• Cancellation Policy: In the event that the client wishes to cancel the commission after payment has been made and work has commenced, a cancellation fee may be applicable. The fee will be determined based on the progress made at the time of cancellation.

• Rights to Decline Commissions: The artist reserves the right to decline commissions that involve certain explicit or offensive content, or go against their personal values and beliefs. The artist also reserves the right to decline commissions at any time, especially if they are unable to fulfill the client's requirements or meet the requested deadline. If the artist decides to discontinue work for any reason, the money will be refunded to the client, but a cancellation fee may or may not be applicable. The fee will be determined based on the progress made at the time of cancellation.

• Any unauthorized use or infringement of the artist's work may be occur taking legal action to protect the artist's rights.

• The artist reserves the right to modify these Terms of Service at any time, without prior notice. Any changes will be effective immediately upon being posted on the artist's website or communicated to the client via email.

REVISIONS:

Revisions to the commission are included in the price and occur at the following approval stages:

•  Rough Sketch with composition and light plan approval.

•  Color/Mood Plan approval

• 50 - 70% progress shot.

• Revisions necessitated by my own faults will be provided free of charge.

• Revisions other than those mentioned above will incur additional fees.

Please be aware that big revisions are only possible during the Sketch stage.

USE POLICY:

You are allowed to transform my art in the following ways:

• Crop the artwork for avatar use.

• Crop it for your website or social media accounts (credit must be given).

• Use it for personal study. If you post your studies online, please include my original artwork with proper credit.

• Print it for personal use.

• Use it as a thumbnail or feature it in videos, provided credit is given in the description.

• You are allowed to post artwork online on your social media feed, but credit must be given.

You are NOT allowed to transform my art in the following ways:

• Colorize my sketches or linework.

• Paint over my work.

• Remove my signature or watermark, unless we agree otherwise.
